Jonathan Yoder, operating as Euphonic Intelligence ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, share, and retain your information when you use the Euphonic Intelligence application (the "Application" or "Service").
Please read this Privacy Policy carefully. By accessing or using the Application, you agree to the collection and use of information in accordance with this policy. This Privacy Policy should be read in conjunction with our End-User License Agreement (EULA).
1. Information We Collect and Use
We collect the following types of information:
A. Chat History: The history of your conversation with the Euphonic Intelligence chatbot, including your messages and the chatbot's responses, will be stored in your session for continuity during your active use.
B. Information from Spotify: When you opt to import your Spotify music collection into Euphonic Intelligence by manually inputting the URLs of your playlists into the designated fields in the application, we make use of the "Get Playlist" endpoint of the Spotify API to retrieve the tracks from your playlists and store them securely in your session. This allows us to understand your musical preferences and create custom playlists for you using your saved songs. When you provide us with a share link for a private Spotify playlist, we use that link to become associated with the playlist in order to retrieve the song titles and artist names in the playlist.
C. Automatically Collected Technical and Usage Data (Session Data):
- Session Identifiers: We use essential cookies to manage your session and keep it secure.
- Track List: If you choose to import your playlists into the Application, a list of the tracks in these playlists will be cached in your session to improve performance during your active use of the Application.
- Technical Information: Your IP address, browser type, operating system, device information, and access times may be logged and used to improve Euphonic Intelligence.
- Usage Patterns: Pages viewed, features used, how you interact with the Application, performance metrics, and error logs may be logged and used to improve Euphonic Intelligence.
BETA NOTICE: Until otherwise stated, Euphonic Intelligence is in it's beta phase. We reserve the right to log and review conversations for quality assurance purposes during this phase.
2. How We Share Your Information
We do not sell your personal information. We do not share your information with advertisers, data brokers, or other marketing platforms for their independent use. We share your information only in the following limited ways:
A. With Google (Gemini API):
- To provide the core AI chat and playlist generation features of Euphonic Intelligence, we send your chat messages to Google's Gemini API for processing. If you choose to import your Spotify playlists, we also send a list of the tracks in these playlists to Gemini.
- Google's use of this data is governed by Google's API Terms of Service and Privacy Policy.
- Your Spotify data, namely the playlists you import into Euphonic Intelligence, is never retained by or ingested by Gemini as per the terms of Euphonic Intelligence's partnership with Google. When you use the application, individual stateless requests are made to Gemini's API, but this data is never stored on Gemini's servers and is never used for training purposes by Google.
B. With Spotify:
- We do not share any of your personal information or chat messages with Spotify. We do not and cannot alter your Spotify account in any way.
- The Spotify playlists created by Euphonic Intelligence are public and may be accessed by any Spotify user.
C. Legal Requirements:
- We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend our rights or property, prevent or investigate possible wrongdoing in connection with the Service, protect the personal safety of users of the Service or the public, or protect against legal liability.
3. Data Retention
We retain your information as follows:
- Chat History: Stored in your session for continuity during your active use and cleared when you press "Reset" or when your session expires (automatically occurs after two weeks).
- Spotify Track List: Stored in your session for performance during your active use and cleared when you press "Reset" or when your session expires (automatically occurs after two weeks). This information is only stored if you choose to import your playlists into the Application.
- Application Caching: Your data (as described in "Information We Collect and Use") may be temporarily stored in a separate, short-lived cache during your immediate use of the application. This information is never stored for more than one hour before being deleted.
- Session Data (General): All session data (including the items described above) is cleared when you press "Reset" or when your session expires (automatically occurs after two weeks).
When you provide Euphonic Intelligence with a share link for a private Spotify playlist, we use that link to become associated with the playlist so that we can retrieve the song titles and artist names. We do not retain the playlist link nor do we save the playlist in Spotify, and we will never retrieve any playlist information after your session has ended.
4. Your Data Rights and Choices
You have control over your information and certain rights depending on your jurisdiction. These may include the right to:
- Access, correct, or update your personal data.
- Request the deletion of your personal data.
- Object to or restrict our processing of your personal data.
- Withdraw consent at any time (for processing based on consent).
If you seek to purge your data from Euphonic Intelligence, click the "Reset" button in the top right-hand corner. This flushes all of your session data from our server.
After pressing "Reset", if you still believe any residual data tied to your past usage might remain, or if you wish to confirm deletion, you can request the complete deletion of all your personal data associated with Euphonic Intelligence. To do so, please send an email to jonathan@euphonicintelligence.com with the subject line 'Data Deletion Request'. Upon receiving a deletion request, we will remove all your identifiable personal data from our active systems within 5 days, subject to any legal retention obligations.
5. Security of Your Information
We take reasonable administrative, technical, and physical measures to protect your information from unauthorized access, loss, theft, misuse, disclosure, alteration, and destruction. This includes using HTTPS for data transmission and secure cookie flags. However, no internet-based service or electronic storage can be 100% secure, so we cannot guarantee absolute security.
6. Children's Privacy
The Application is not directed to, nor intended for use by, children under the age of 13 (or the equivalent minimum age in the relevant jurisdiction if higher). We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without verification of parental consent, we will take steps to remove that information from our systems. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us.
7. International Data Transfer
Your information, including personal data, may be transferred to (and maintained on) computers and servers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including personal data, to the United States and process it there, as well as potentially in other locations where our service providers (like Google for Gemini API) operate.
Your use of the Service followed by your submission of such information represents your agreement to that transfer. We will take steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and applicable data protection laws.
8. Spotify as Third-Party Beneficiary
You acknowledge and agree that Spotify AB ("Spotify") is a third-party beneficiary of this Privacy Policy. As such, Spotify shall have the right (and will be deemed to have accepted the right) to enforce any provisions of this Privacy Policy that relate to the Spotify Platform, Spotify Content, or Spotify Personal Data directly against you.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, service offerings, or legal requirements. We will notify you of any material changes by posting the new Privacy Policy within the Application and updating the "Last Updated" date at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page. Your continued use of the Application after such changes indicates your acceptance of the revised policy.

1. INTRODUCTION AND ACCEPTANCE OF TERMS
This End-User License Agreement ("Agreement" or "EULA") is a legal contract between you ("User") and the Application developer ("we", "us", or "our"). By installing, accessing, or using the Application, you agree to be bound by these terms. If you do not agree to these terms, do not use the Application.
2. DESCRIPTION OF SERVICE
The Application generates custom playlist recommendations using AI technology in conjunction with your input via chat. If you choose to import any playlists into the Application, it analyzes your music and may provide custom playlists based on your saved songs. The Application is designed solely for your personal, non-commercial enjoyment of playlist recommendations.
3. LICENSE GRANT AND RESTRICTIONS
License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application solely for your personal, non-commercial purposes.
- Reverse-engineer, decompile, disassemble, modify, create derivative works, or otherwise attempt to derive source code from any Spotify SDKs, Platform, Service, or Content used by the Application.
- Bypass security mechanisms or interfere with the proper functioning of the Spotify Platform.
- Use the Application to train your own AI/ML models on Spotify Content.
- Copy, distribute, or make the Application or Spotify Elements available to any person, except as expressly provided in this EULA.
- Use the Application or Spotify Elements for any illegal or unauthorized purpose.
- Attempt to circumvent or render ineffective any geographical restrictions or other technical protection measures.
4. SPOTIFY INTEGRATION AND THIRD-PARTY BENEFICIARY
Non-Affiliation
This Application is not affiliated with, endorsed, or sponsored by Spotify.
Third-Party Services
You acknowledge that the Application integrates with Spotify services operated by Spotify. Your use of Spotify's services is subject to Spotify's Terms and Conditions of Use, which are separate from this Agreement.
Third-Party Beneficiary
Spotify is an express third-party beneficiary of this EULA and the Privacy Policy, and is entitled to directly enforce its terms against you. Spotify may enforce any failure by you to comply with the terms of this Agreement, including without limitation the prohibition against reverse-engineering and unauthorized use of Spotify Content.
5. YOUR RESPONSIBILITIES
- You agree not to use this Application for any unlawful, offensive, or prohibited purpose.
- You agree to comply with all applicable laws and Spotify's policies when using this Application.
6. DISCLAIMERS AND WARRANTIES
No Warranties
THE APPLICATION AND ANY SPOTIFY CONTENT, PLATFORM, SERVICE, OR SDKS IT UTILIZES (COLLECTIVELY, "SPOTIFY ELEMENTS") ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS, AND WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Third-Party Disclaimers
NO WARRANTIES OR REPRESENTATIONS ARE MADE ON BEHALF OF SPOTIFY. TO THE EXTENT SPOTIFY CONTENT IS PROVIDED, SPOTIFY MAKES NO WARRANTIES REGARDING THAT CONTENT.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE OR SPOTIFY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OR ANY LOSS OF DATA, REVENUE, OR PROFITS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION.
8. TERMINATION
This Agreement is effective until terminated. We may terminate or suspend your access at any time, with or without notice, if you breach any term of this Agreement. Upon termination, you must cease all use of the Application.
9. CHANGES TO THIS AGREEMENT
We may update this Agreement from time to time to reflect changes in our practices, service offerings, or legal requirements. We will notify you of any material changes by posting the new Agreement within the Application and updating the "Last Updated" date at the top of this Agreement. You are advised to review this Agreement periodically for any changes. Changes to this Agreement are effective when they are posted on this page. Your continued use of the Application after such changes indicates your acceptance of the revised agreement.
